Gantua Terms of Service
Last updated: 29 September 2026.
These Terms govern your use of Gantua's website and, if you create an account or place an order, its AI-assisted service. Gantua is provided by GARGANTUAN SDN. BHD. (registration number 202601035957 (1698052-A)), 15-2, Dinasti Sentral, Jalan Kuchai Maju 18, Off Jalan Kuchai Lama, 58200 Kuala Lumpur, Wilayah Persekutuan Kuala Lumpur, Malaysia ("Gantua", "we", "us"). You accept these Terms when you create an account or otherwise expressly agree to them. Simply browsing the public website does not create a paid subscription.
1. Eligibility and accounts
You must be at least 18 or the age of majority where you live, whichever is higher. You may use eligible Gantua features personally or for a business. If you accept these Terms for a business, you confirm that you can bind it. Keep your account information accurate, protect your credentials and tell us promptly about suspected unauthorised access.
Adults using a personal account may use general AI and creation features where offered. Company-account connections, business outreach and business expenditure require a business workspace and a user authorised to act for that business. An account connection does not, by itself, authorise Gantua to take every action available through it.
2. The service and your instructions
Gantua helps plan, create and carry out work through AI and connected services. Available features and limits are those shown in your accepted order and product information. Outputs can be inaccurate, incomplete or unsuitable; review them according to their consequences. Gantua does not guarantee revenue, customer acquisition or other business results, and does not replace qualified professional advice.
You may instruct Gantua only concerning accounts, materials and activities you have authority to control. Gantua may carry out supported and scheduled actions within the permissions, scope and budgets you expressly approve. It must seek fresh approval before acting outside those limits. Silence, a connected account or an available credit balance does not expand your authority.
Even with standing permission, each legally binding contract or commitment, transfer of money or payment from your account, and deletion of an external account or external-service data requires fresh approval for that action. Public posts and outbound messages may be sent under standing permission that defines the connected channel, permitted content and audience or recipient criteria, schedule or frequency, and campaign or spending limits. A materially different channel, audience, content category or budget requires fresh authority. Applicable marketing, privacy, consent and platform rules still apply.
When you revoke or narrow a permission, Gantua stops new actions under it once the change takes effect and holds or cancels queued actions that have not started. Work already in progress is stopped where technically possible. Revocation cannot recall delivered messages, reverse completed purchases or undo effects on another platform. Activity records should identify actions and costs already committed.
3. Connected services and external spending
Your use of a connected service may also be governed by that service's terms. Gantua may change the providers it uses to deliver its service, but a provider change does not increase your approved spending authority, change an existing credit's expiry or give us new rights to use your information. We will provide applicable provider and subprocessor information separately and give notice or obtain authorisation where required.
Gantua subscription fees, Gantua usage credits and separately authorised external expenditure are distinct. We will show the price or budget and material cancellation or refund restrictions before a separately charged third-party purchase is approved. New external spending stops at its separately approved budget; buying more Gantua credits does not raise that budget. We do not bind you automatically to unknown future provider terms.
If you cancel a task, we may recover a separately authorised external cost only when Gantua actually incurs a direct, documented provider charge within your approved budget for that task. If an external provider fails but still charges Gantua, the same actual and unrecoverable cost may be passed through only if we disclosed that risk before you approved the spending. Estimates and reserved amounts are not enough. Provider waivers, credits or refunds reduce or reverse your charge. We do not pass through a cost caused by Gantua's own error or charge separately for an AI-provider cost already included in Gantua credit pricing. Your express remedies and mandatory legal rights remain available.
4. Subscriptions, credits and cancellation
Your accepted order or checkout states your plan, price, currency, taxes, billing period, included credit allocation and renewal terms. These Terms do not fix plan names or prices. A recurring subscription renews as disclosed and agreed at checkout. Cancelling it stops the next renewal charge; paid-plan access continues through the current paid period. Account closure is a separate action under section 8.
Subscription credits are issued monthly, and each batch expires two months after issue. Separately purchased top-up credits expire six months after purchase. Eligible credits are used in earliest-expiry-first order. Unused credits can cross billing periods within their original validity window. Cancelling a subscription does not remove issued credits or extend their original expiry. Credits stay with the purchasing account and cannot be transferred or redeemed for cash.
Chargeable AI work and paid backend services pause when eligible credits reach zero, without a grace period. Public website pages remain served, though functions requiring paused services will be unavailable. Exhaustion does not authorise use beyond available credits. Automatic top-ups are off by default; you must enable them expressly and set a spending limit. A failed top-up or reached limit does not allow unfunded usage. External expenditure remains subject to its separate budget.
Credits are charged for work performed even if you dislike the result, subject to your remedies and applicable law. If a Gantua technical failure prevents delivery, we restore credits charged for the affected work. If you stop a task, we charge only for work already performed. We disclose when a retry will use further credits and do not charge again for work needed to recover from our own technical failure.
Except where these Terms, your order or applicable law provide otherwise, unused credits and paid fees are non-refundable. Cancellation alone does not refund the current paid period or unused credits; issued credits remain usable until expiry. If we discontinue a prepaid service without your breach, we refund the unused prepaid portion of the affected service. If we materially fail to provide a purchased service and do not remedy that failure within a reasonable period after notice, you may terminate the affected service and receive a refund of its unused prepaid portion. We correct billing errors and unauthorised charges as required by law. Consumer cancellation and other mandatory rights are unaffected.
Price increases apply prospectively after appropriate notice and an opportunity to cancel before the new charge. The price and terms of an accepted prepaid period do not change retroactively.
5. Your materials, outputs and confidentiality
You keep rights you hold in materials you provide. You give us the limited rights needed to host, process and transmit them to deliver authorised work, secure the service and meet legal obligations. To the extent Gantua holds transferable rights in work generated for you, we assign those rights to you. We cannot transfer third-party rights we do not hold or guarantee that AI output is unique or protected by copyright. Third-party assets may carry disclosed licence restrictions. Gantua and its licensors retain the service software, branding and underlying technology.
Each party protects the other's information marked confidential or reasonably understood to be confidential, including private workspace content and non-public business, product or security information. Each party uses reasonable care, gives access only to people or providers who need it and have appropriate obligations, and uses it only for authorised purposes. This does not cover information independently developed, lawfully received without restriction or already public through no breach. A party may disclose information when lawfully required, limiting the disclosure and giving notice where permitted.
Our Privacy Policy explains personal-data handling. Where Gantua processes business data on a customer's instructions, a separate data-processing agreement may apply. We do not currently use customer content to train shared AI models. Neither the service-delivery licence nor the confidentiality clause grants an unrestricted right to do so. Any future optional model-improvement use requires advance notice, the choices described in the Privacy Policy and any consent required by law.
6. Acceptable use
Do not use Gantua for unlawful activity, fraud, harassment, exploitation, deceptive impersonation, infringement, unauthorised system access, malicious software or evasion of safety limits. Do not submit information or issue instructions you lack authority to use. Business outreach must comply with applicable marketing, privacy and platform rules; connecting a contact list does not establish permission to message every person in it. Do not use unsupported features for high-risk or regulated decisions. We may investigate credible misuse and take proportionate protective action.
7. Service changes and liability
Features depend in part on third-party services and may change. We will give appropriate notice of material reductions and honour express commitments and remedies for prepaid service. We do not guarantee uninterrupted or error-free operation. Nothing in these Terms limits liability or remedies that applicable law does not permit us to limit.
For Business Customers only, to the extent permitted by law, neither party is liable to the other for indirect or consequential loss, including lost profits or business opportunities. Each party's aggregate liability arising from these Terms is limited to the greater of (a) fees actually paid for the affected Gantua service in the 12 months before the event giving rise to the claim, or (b) USD 1,000. Subscription and usage-credit payments for that service count toward (a); separately itemised third-party expenditure does not. This calculation does not itself exclude liability for that expenditure. Payment obligations properly due, fraud, wilful misconduct and liabilities that cannot lawfully be limited remain outside the cap. Subject to those exceptions and applicable law, the cap applies to confidentiality, data-protection and security breaches and actions outside agreed authority. It does not reduce the express refund and credit-restoration remedies in section 4.
For Business Customers only, you will defend and indemnify Gantua against a third-party claim to the extent it arises from material you provided without necessary rights, your unlawful instructions or use, or an authorised action that violates a third party's rights because of your material or instructions. This does not cover a claim to the extent caused by Gantua's breach, action outside agreed authority, negligence or misconduct. The covered indemnity is outside the business liability cap and consequential-loss exclusion, to the extent permitted by law. The business cap and indemnity do not apply to Consumers; their applicable statutory protections remain intact.
8. Suspension, account closure and data export
We may restrict access where reasonably necessary for material breach, security risk, non-payment or legal requirements. We will give notice and a reasonable chance to remedy where appropriate, unless an urgent risk or legal restriction prevents it.
When account closure takes effect, AI tasks, scheduled operations and new external spending stop, and Gantua-hosted public sites and paid backends are disabled. Previously authorised external contracts may have independent effects; section 3 governs any cost passed through to you. For 30 days after closure, we provide export-only access to retained exportable account data, subject to necessary security and legal restrictions and an appropriate alternative route where required. Export access does not continue hosting or AI execution. Account content is then deleted under the applicable retention schedule, subject to documented legal obligations, disputes, backup expiry and processor deletion. Closing an account does not remove any refund entitlement under section 4 or applicable law.
9. Complaints, changes and governing law
Contact support@gantua.com for service complaints or legal@gantua.com for legal notices. For privacy requests, contact privacy@gantua.com. We will give appropriate notice of material changes and seek fresh agreement where required. Changes do not retroactively authorise new data use or spending.
These Terms are governed by Malaysian law. Subject to mandatory rights and jurisdictional rules, disputes are submitted to the competent Malaysian courts. This does not deprive Consumers of protections or remedies they cannot waive under applicable law, including a right to use another competent forum.
